未成年人恢复性司法的应然与实然

Ideal and Factual Construction of Juvenile Restorative Justice

恢复性司法发端于域外未成年人领域司法实践的有益尝试，未成年人司法理念与恢复性司法存在诸多契合，在空间上得到迅速拓展的未成年人恢复性司法不断进行发展完善，并形成了多种实践模式，同时其在司法程序中较为成熟的运行路径呈现了未成年人恢复性司法实践的应然模式。然而，未成年人恢复性司法在进入我国后，虽有基层实践者的适用和推动。但是由于理念、影响、参与的局限性致使其在我国形神分离。因此，需要考虑从社区理念与实体的建构，专业社工队伍的建设，适用阶段的拓展等方面切入，以达成未成年人恢复性司法在我国的本土化．并从完善未成年人司法体制的高度出发，提升未成年人恢复性司法的延伸性。

Restorative justice was originated from the beneficial judicial practice in extraterritorial field of juvenile. There are plenty of conjunctions between the principles of juvenile justice and restorative justice. Juvenile restorative justice has been developing constantly on the basis of rapid expansions on space and has formed a variety of practice patterns. At the same time, its relatively mature run path in the judicial process presents the ideal construction of juvenile restorative justice. However ,juvenile restorative justice in our country unfold desirable current situation because of the limitation of concept, influence and participation, even though grassroots legal practitioners have applied and promote it. Therefore, we need to consider from the construction of community theory and entity, the establishing of professional social workers team, and expansion of applicable stages, etc, to achieve the localization of juvenile restorative justice in our country and improve the extensibility of the juvenile restorative justice from the height of the perfect juvenile judicial system.
