The Rationality Validity and Prospect of the Judicial Assessors' Participation in the Implementation Work

人民陪审员参加执行工作虽然没有法律明文规定,但由于执行行为属于司法行为,体现出司法公正这一价值取向,人民陪审员参加执行具有相当的合理性。在X市人民法院的陪审员参加执行工作的实践中,这一制度也体现出自身的优势。要建立陪审员参加执行制度,可通过修改《全国人民代表大会常务委员会关于完善人民陪审员制度的决定》和制定司法指导性文件来实现。

Although the judicial assessors＇participation in the implementation work isn＇t defined by law, because the implementation which is part of the judicial act should reflect the value of judicial justice, the participation of the judicial assessor is quite reasonable. When I participated implementation work in X city as the judicial assessor, this institution also reflects its own advantages. To establish the judicial assessors＇ participation in the implementation, we could modify the Decision about improve the judicial assessors＇ system of the National People＇s Congress Standing Committee and make some judicial guidance documents.
