摘要
法治现代化是指法律在由传统社会到现代社会的转变以及在这个转变过程中所彰显的法律制度自身的合理化,是人类法律文明的发展与跃进的必然结果。在国家治理现代化的视阈下,法治现代化包括法治体系现代化和法治能力现代化两个维度。法治现代化不仅是国家治理现代化的应有之义,而且在国家治理现代化过程中发挥着能力"提升"功能、善治"奠基"功能以及价值"引领"功能。
The modernization of legality refers to the transformation of the law from the traditional society to the modern society and the rationalization of the legal system which is manifested in the process of transformation.It is the inevitable result of the growth and leap of human legal civilization.From the perspective of national governance modernization,the modernization of legality includes the modernization of legal system and the modernization of legal ability.The modernization of legality is of great significance to the modernization of state governance.It is not only the basic connotation of modernization of the state governance,but also plays a role in improving ability,laying a foundation for good governance and value guidence.
