基层检察院办理虚假诉讼监督案件的思考——以斯××与余××等四人虚假民间借贷纠纷案为例

在司法实践中,"当事人"出于非法动机和目的,利用法律赋予的诉讼权利,采取虚假的诉讼主体、事实及证据的方法提起民事诉讼,使法院作出错误的判决、裁定、调解,以图谋取不正当利益的虚假诉讼时有发生。虚假诉讼不仅严重侵害了利益相关方的合法权益,造成司法资源的极大浪费,更对司法公信力与社会诚信体系带来严重损害。虚假诉讼多发于基层,从行为手段看,极具欺骗性和隐蔽性。基层检察机关在虚假诉讼监督实践中如何拓展虚假诉讼的案件来源,如何有效办理虚假诉讼监督案件是从事民行检察监督工作干警需要思考的问题,本文以西塞山区人民检察院办理的斯×××与余×××等四人虚假民间借贷纠纷案为例,对上述两个问题进行一定的探索,以期更好掌握虚假诉讼监督规律,切实发挥检察机关虚假诉讼监督实效。
