我国省级环保厅局权力清单的权力项数量比较分析

A Comparative Analysis of the Amount of Administrative Power Items on the List of China’s Environmental Protection Bureau at Provincial Level

笔者通过对31个省级环保厅(局)的权力清单进行统计发现,各省级环保厅(局)的权力项总数、权力项类型数及各类型下的权力项数量差距甚大,这说明省级环保厅(局)的权力边界具有不正常的伸缩性、权力行使的力度差异太大、部分地区的环保权力存在真空,产生这些问题的原因在于权力主体价值观的偏离、相关主体的博弈和欠发达地区对环保权力项数量的刻意约束,而优化省级环保权力清单权力项数量的路径在于:相关部门要树立有限权力观、勤政为公的工作观、绿色发展观;要重塑博弈格局,让公民和人大参与到环保权力清单的制定中来;要对欠发达地区实行环保补贴。

After running statistics on the power list of thirty-one protection bureaus atprovincial Level, it’s found that the total number of administrative power in protection bureau atprovincial level, the number of the type of administrative power and the number ofcorrespondent administrative power of diverse type differ greatly, which shows abnormalflexibility, wide gap in the exercise of rights and power vacuum in environmental protection insome regions. The root causes of the problem mentioned lie in the deviation of mainstreamvalue, the game-playing of entities concerned as well as the deliberate limitation ofadministrative power items by the local authorities in less developed areas. Therefore, tooptimize administrative power list of environmental protection on the number of administrativepower item at provincial level, the authorities concerned should foster an outlook on limitedpower, hark work to serve the people and pursuit of green development. Besides, it also callsfor restructuring of game-playing, involving citizens and the National People’s Congress in themaking of administrative power list of environmental protection. Furthermore, subsidies shouldbe given to less developed regions.
