我国生产者责任延伸的法律体系建设

目前我国生产者责任延伸立法体系未形成系统性总体框架,立法导向偏颇、缺乏刚性约束,责任主体缺失、责任内容不明确,制度建设与实施不完全;为此,提出了以《循环经济促进法》为基本法,确立我国生产者责任延伸制度的立法框架,明确界定相关责任主体与具体责任,构建行政管制与经济调节相结合的制度体系,确立以环境优先导向的立法建设,构建完善的EPR制度,实施完全的延伸责任。

At present, China＇s responsibility extension legislation system of producers does not form a systematic general framework, the legislation is biased, lack of rigid constraints and responsibility subject caused the vague of content of responsibility, so the system construction and implementation is not complete. Therefore, putting forward the ＂circular economy promotion law＂ as the basic law, the establishment of China＇s producer responsibility extension of the legislative framework clearly defined the main responsibilities and specific responsibilities, building administrative control and economic regulation of the system, and establishing the environment -oriented legislation to build a comprehensive EPR system, so that the implementation of a complete extension of responsibility will be effective.
