海事行政处罚归责原则的思考

Research on the principle of liability imputation on maritime administrative punishment

笔者结合海事行政管理实际,对海事行政处罚适用的归责原则进行研究分析,并作出修改上位法、出台配套规定、细化适用标准等多项建议,意在从立法、行政、执法多层面统一处罚原则,强化法治理念,实现行政执法规范化和相对人合法权益的维护。

In view of the practice in maritime administration, the paper conducts studies on the principles for the liability attribution in maritime administrative penalty, and proposes suggestions fiom such aspects as making revision to laws of higher levels, promulgating supporting regulations and developing detailed applicable standards, aiming at unifying the principles for the penalty and enhancing law-governance awareness from legislatiou, administration, law-enforcement and etc., regulating administrative law-enforcement, and protecting the legitimate rights and interests of administrative counterparts.
