摘要
美国传媒产业法律是分散型立法模式,可分为报刊图书出版、互联网、广播电视等行业法以及知识产权、税收等专项事务法。美国传媒产业的分散型立法是以版权交易为机制,以版权法为中心的法律体系,具有自然形成型、市场机制型和法律传统型的特点。研究美国传媒产业立法模式可为我国提供批判性的借鉴,即要坚持根据我国的历史发展、法律传统等现实国情,找到适宜的中国传媒产业立法模式;坚持建立市场"无形之手"和政府"有形之手"协同的传媒产业法律体系。
The law of American media industry is a dispersive model, can be divided into newspapers, books, Interact, radio, television, and other law of the industry, and intellectual property, taxation, international media communication and traditional law model. This critical examination of American media legal system will be a reference for China's law- making, and it means we should find an appropriate model to establish laws of Chinese characteristics, which should be based on the historical development of China's legal tradition and China's actual conditions. China's media law making should be persistent with combining "invisible hand" of the market and "visible hand" of the government.
