县级以上地方各级党政机关应当普遍设立法律顾问、公职律师，建立以党内法规工作机构、政府法制机构人员为主体，吸收法学专家和律师参加的法律顾问队伍。法律顾问队伍，是党委政府重大决策的特色新型智库，是党委政府用法治思维和法治方式推进改革、促进发展的重要参谋助手。有效发挥法律顾问作用，应探索完善法律顾问参与市委、市政府重大决策的途径和方法，完善法律顾问工作机制。行政机关应积极为法律顾问工作创造良好环境，搞好优质服务，使法律顾问制度规范化运行。
