检察机关适用指定居所监视居住问题研究

Study on the Application of Designated Residence in Procuratorial Organs for Surveillance of Residence

刑事诉讼法规定,检察机关在侦查犯罪嫌疑人无固定住处或特别重大贿赂犯罪案件时,可以适用指定居所监视居住。因此,以指定居所监视居住的适用情况为切入口,旨在对检察机关适用指定居所监视居住这一强制措施的相关问题进行系统的论述,提出完善指定居所监视居住的建议,以期指定居所监视居住得到更好更适当地运用。

The Criminal Procedure law stipulates that the Procuratorial organs may apply for designated residence to supervise the residence when investigating criminal suspects who have no fixed residence or major bribery crimes. Therefore, specifying the applicable conditions of residence under surveillance as the start point, this paper aims to make a systematic discussion on issues related to the compulsory measures of surveillance of residence and puts forward suggestions for the perfection of this regulation in order to bring its application into full play.
