海关缉私两法衔接机制若干问题研究

A Research of Convergence Mechanism of Administrative Law Execution and Criminal Justice for Customs Anti-smuggling Problems

海关缉私两法衔接机制主要包括制度衔接、机构衔接、信息衔接、外部监督衔接等几个方面。目前其存在的主要问题是执法自由裁量的标准不够规范、执法主体各自为战、案件信息松散、证据转换规则缺位等。为了克服海关缉私两法衔接机制中存在的问题,可细化海关缉私行政执法裁量规则和标准,统一执法意识,促进机构联系和信息交流,加强海关缉私证据转换的可操作性以及建立健全海关缉私内、外部监督机制。

The convergence mechanism of administrative law execution and criminal justice of customs anti-smuggling mainly includes the converging system, institution convergence, information convergence, ex-ternal supervision convergence and so on. There appear problems such as none-standardization of the power of the administration enforcement discretion, separate ways of the main law enforcement, the loosen case in-formation and the deficiency in evidence transition rules. In order to overcome the problems existing in the convergence mechanism of administrative law execution and criminal justice of customs anti-smuggling, ef-forts need to be made to refine the rules and standard of the discretional power of administrative law en-forcement of the customs anti-smuggling, unify the awareness of law enforcement, promote institutional links and information exchange, to enhance the operability of transition of the evidence as well as to establish the sound internal and external supervision mechanism of the customs anti-smuggling.
