“三权分置”下的征地补偿费分配问题研究

土地三权(所有权、承包权、经营权)分置,衍生了源于土地集体所有权的集体收益权、源于农户承包权的承包收益权、源于土地经营权的经营收益权。在大规模土地征用开发过程中,巨额的土地补偿款作为土地收益的集中表现形式,在集体与农户以及不同权益主体之间进行分配。"三权分置"对征地补偿款分配具有决定性影响,它使村集体、普通承包农户以及承包大户(经营性农户)之间形成了巨大的补偿款分配差距,并有可能带来农户之间土地收益(收入)分配的非平均化,进而造成农户之间的收入分化。

The division of the three rights（ownership,contract rights,management rights） of land has brought about the collective income right（which is derived from the collective land ownership）,contract income right（which is derived from the right of contract for land）,and management income right（which is derived from the right to manage land） respectively.In the process of large-scale land expropriation,the enormous amount of land compensation,as a centralized form of land income,is allocated both between the collective and farmers and among different subjects representing different rights and interests.＂Three Rights Division＂has a decisive influence on the allocation of land compensation,forming the big gap of compensation distribution among the village collective,the common farmers and the large contractors（operating households）,possibly bringing non equalization of land income,and leading to the increasing income polarization among farmers.
