大数据环境下我国涉诉信访改革思考

涉诉信访一直是困扰我国司法领域的一道难题。破解涉诉信访的难题除需要司法体制改革外,还需要现代技术的支撑。大数据能为司法公开、司法审判管理平台乃至社会诚信体系建设提供全方位的信息化服务。将大数据应用于涉诉信访治理,一方面,能最大限度减少司法人员工作量,提高司法效率;另一方面,能够减少司法机关处理案件时的盲目性与随意性,提高息访的成功率,更好地维护社会稳定和司法权威。在大数据应用于涉诉信访的过程中,我们应该在规则制定、软件设计等方面注意透明性和可问责,以防范可能出现的风险。

Complaint involving lawsuits have always been a puzzle in the judicial field of our country. In addition to the judicial system reformation,we still need the support of modern technology to solve the complaint involving lawsuits problems. Big data technology can provide data service for the reformation of the judicial system,and provide a full range of information for the judicial openness,for the construction of the judicial management platform and even for the building of the social trust system. Promoting the use of big data in the complaint involving lawsuit reformation,on the one hand,can minimize workload of the judiciary and improve judicial efficiency; on the other hand,can reduce the blindness and randomness during handling the lawsuit cases,better safeguard social stability and judicial authority,improve the success rate of dealing with the petitions.When we use the big data in the process of complaint involving lawsuit,we should pay attention to the possible risks during rulemaking and the software design,and guard against the transparency and accountability.
