论农村集体经济组织收益分配纠纷的司法救济:重庆例证

On Judicial Remedy of the Income Distribution Disputes in Rural Collective Economic Organizations:A Case of Chongqing

在国家大力发展农村经济,减轻农民负担,提高农民生活水平的政策背景下,如何妥善解决农村集体经济组织收益分配矛盾纠纷是直接影响村民成员生存权益和农村经济发展、社会稳定的重要现实问题。由于缺乏具体细化的法律、法规规范,现行司法救济制度存在缺陷,救济效果并不理想,其中最为突出的是成员资格认定、分配程序合法性审查等问题。故应从树立正确的裁判理念入手,通过明确成员资格认定标准、统一分配程序司法审查模式、建立以收益性质区分为基础的适当性判断规则等多方面的机制创新,逐步实现司法救济制度的完善。

The state is now developing rural economy, reducing peasants＇ burdens and improveing peasants＇ living standards, in such context, the proper handling of the income distribution disputes in rural collective economic organizations will have great effect on survival rights of the peasants and the economic development and social stability in rural areas. The judical remedial system is not so efficient for lack of concrete and specified laws and regulations. The most striking conflicts thus arising are such problems on the recognition of the membership and the distribution procedures. It is of great importance to perfect the judicial remedial system through mechanism innovation from following aspects： establishment of a correct judical concept, formulation of a transparent standard of membership recognition, unification of judical review model on income distribution and the appropriate adjudication rules based the distinction between the nature of income.
