中国民法典设置条标新论

A New View on Adding Article Headings to China's Civil Code

《中华人民共和国民法总则》已经十二届全国人大五次会议通过,正式出炉。它与以往全国人大通过的法律一样,没设条标。其实,中国的民法典中应设置条标,因为这具有多重意义,包括向世界展现一部具有21世纪水平的民法典,传承中国传统律典中设置条标的优秀传统,融入当今世界民法典制定的潮流等。条标在中国民法典中具有不可替代的作用,有利于民法典的制定与实施,民法典的教学与研究,民法典的宣传与传播。

General Rules of Civil Code of People＇s Republic of China （hereinafter referred to as China＇s Civil Code） has been adopted at the 5th Session of 12th National People＇s Congress （NPC）. Same with laws previously adopted by NPC, it does not have article headings. China＇s Civil Code, in fact, shall add article headings for various significances, such as showing the world a civil code featuring the legal ＂ advancement in the 21st century, carrying forward the traditions of article headings in China＇s traditional codes and integrating into world trend of formulating civil codes. Article headings, which play an indispensable role in China＇s Civil Code, are conducive to the formulation and implementation, teaching and research, as well as the publicity of the Civil Code.
