法律监督视野下检察职能定位的再思考

Reconsideration of the Orientation of Procuratorial Function from the Perspective of Legal Supervision

在新一轮司法体制改革对优化检察职能提出具体时间表之际,检察机关的职务犯罪侦防部门面临着整体转隶国家监察委员会,原有的检察监督体系有待优化,检察职能亟需重新定位。从法律监督的本源深度剖析当前面临的困境,提出构建未来新型检察监督职能体系的设想,以达到科学配置检察职能并实现良性运转的法律效果和社会效果。

At the new round of judicial system reform requiring optimizing procuratorial function within concrete timetable,the department of investigation and prevention in procuratorial organs will be transferred to state supervision commission and the original procuratorial and supervision mechanism shall be optimized. Therefore,the allocation of procuratorial function shall be reoriented. This paper analyzes the current predicaments from the perspective of origin of legal supervision and puts forward the idea of constructing a new type of procuratorial supervision mechanism in order to achieve the legal and social effect of scientifically allocating procuratorial function and sound operation.
