摘要
老字号延续性保护中的人格利益考量,已经是不容忽视的问题。对于企业名称权的真正定位,我国目前仍然没有一个定论,对于人格权单独规定的担忧始终充斥着整个法律界,但是从企业名称权冲突和解决时的混乱局面不难看出当前法律上的规制是不够的。在民法总则中明确法人的人格权是非常重要的尝试,有利于解决我国市场经济快速发展过程中社会存在的多种冲突。一味保守地停滞不前将会固守法律的滞后性而掩盖法律的规制性和灵活性特征,这对于法治国家建设中的人权保障是没有促进作用的。
