健全水资源资产管理体制的思考与建议

Thoughts and Suggestions on Perfecting the Management System of Water Resources Assets

按照生态文明体制改革精神,探讨构建符合我国国情水情和当前改革形势要求的水资源资产管理体制。运用政策解读、法理分析、比较分析等方法,剖析了自然资源资产分类管理要求,梳理了水资源资产管理体制现状,分析了水资源资产管理的特殊性和实行专业化管理的必要性,提出了进一步健全水资源资产管理体制的思路和建议。研究提出,水资源资产属于典型的公益性资产,考虑到水资源资产管理和我国国情水情的特殊性以及当前我国所处的特殊发展阶段,有必要充分发挥水行政主管部门的专业管理能力,进一步明确由水行政主管部门作为所有权代表行使水资源资产管理职责;按照一件事由一个部门管理的原则,有必要以水为脉络,对涉及水资源资产管理的相关部门进行整合,实现水资源资产的统一管理和监督,并从国家、流域和区域三个层面进一步健全部门协作机制。

In accordance with the spirit of ecological civilization system reform,this paper discussed the building of water resources asset management system in line with China＇s national conditions,water conditions and the current reform situation. Using policy interpretation, legal analysis,comparative analysis and other methods,it analyzed the requirements of natural resources assets management,the current sit-uation of water resources assets management system,the particularity of water resources assets management and the necessity of the imple-mentation of professional management,and put for^-ard ideas and suggestions to further improve the water resources assets management sys-tem. It suggested that considering the particularity of water resource assets management,the situation of China and the current regime of China＇s position in the special stage of development,water resources assets belong to public assets,and it is necessary to give full play to the water administrative department for professional management,further define the water administrative department as the representative of the ownership responsible for asset management. It is also necessary to integrate the relevant departments involved in water resources asset man-agement for unified management and supervision of water resources assets, and further improve the cooperation mechanism among departments at the levels of nation,watershed and region.
