Analyses on the Copyright of Net Literature

通过对近年来网络文学版权纠纷案件进行实证研究,发现在互联网时代,网络文学侵权变得更加容易,侵权成本低。在深入分析网络文学版权纠纷案例与研究网络文学版权法律保护困境基础上,提出针对性的法律对策,以促进网络文学版权保护"立法-司法-执法"三方位一体化体制的构建,为社会形成良好的网络文学版权维权机制,实现网络文学版权贸易公平化提供借鉴。

Through an empirical study on the dispute cases of net literature copyright in recent years, it is found out that in the internet age infringement of net literature has become very easy, with the low cost of infringement. The paper deeply analyzes the dispute cases of net literature copyright and studies the legal protection dilemma of net literature copyright, and then puts forward some targeted legal measures in order to promote the construction of trinity system about the copyright protection of net literature, including legislation, judicature, and law enforcement, and to provide some references for the formation of the fine right protecting mechanism about net literature copyright in our society, and the realization of copyright trade fairness of net literature.
