国家教育权研究现状和发展趋势

Status Quo and Development Trend of the Research on the Right of National Education

摘要 国家是现代教育权的主体,国家教育权的存在价值是将社会整体的公共性教育资源应用于每一个受教育客体之中。目前,我国国家教育权的行使还存在法律体制不完善、权力滥用、司法监督体系不健全等方面的问题。需要从国家、社会各个角度加强对国家教育权的规范行使,充分实现并保证教育的公平性、公益性。 The state is the main body of the right of modern education, and the existence value of the state education right is to apply the public educational resources of society as a whole to every object of education. At present, the exercise of the right to education in China still has some problems such as imperfection of legal system, abuse of power, and imperfect judicial supervision system. It is necessary to strengthen the exercise of the state's fight to education from the perspective of the state and society so as to fully realize and guarantee the fairness and public welfare of education.
