社会治理创新与法治政府建设必须在法律框架内进行,法律能够为社会治理创新与法治政府建设设定价值目标,提供观念动力、制度资源和稳定预期。要实现社会治理创新与法治政府建设的良性互动,就必须运用法治思维和法治方式解决政府与社会合作治理中的问题,在立法安排方面坚持利益结构调整与行为控制的有机结合,在治理的方式选择方面坚持刚性管理与柔性管理的有机结合,在社会纠纷解决途径的选择方面坚持社会调解和法律解决的有机结合,在治理的理念培育方面坚持政府干预与社会自治的有机结合。要实现社会治理创新与法治政府建设的良性互动,必须坚持法律效果和社会效果、秩序维护与自由保障、立法保障与司法支撑、科学决策与民主管理的有机统一原则。

Social governance innovation and the rule of law government construction must be car- ried out within the framework of law, which can provide value goal, force of idea, systemic resources and steady expectation for the innovation of social governance and the rule of law government con- struction. To achieve the positive interaction of the social governance innovation and the rule of law government construction, we must take into account and solve the problems arising in the cooperative governance between government and society in line with law, integrate interest structure adjustment with behavior control in legislative arrangements, combine rigid governance with flexible governance in governance methods, resort to both mediation and lawsuit in settling social disputes, and insist on the combination of governmental intervention and social self-governance in the cultivation of governing ideas. In addition, we must stick to the organic unity of legal effect and social effect, order mainte- nance and freedom, legislative and judicial supports, and scientific decision-making and democratic management.
