知识产权政策动态调整——韩国案例研究

Dynamic adjustment of intellectual property policy : A case study of Korea

知识产权政策不是一成不变的,我国已经进入创新驱动发展新阶段,需要知识产权政策动态调整。以韩国为案例,从经济基础、支撑要素、参与主体三个维度,研究其知识产权政策调整的基础、动力和内容。研究发现:对应一个国家不同发展阶段,最优知识产权保护强度的选择有所不同;随着经济发展水平提升和经济发展模式转型,知识产权保护将必然走向强化,严格的知识产权政策将逐渐成为趋势;不仅要看到知识产权政策对促进创新的作用,同时创新能力的提升,也在改变一国的知识产权政策。

Intellectual property policy is not invariable. China has stepped into a new innovation-driven stage and needs to adjust intellectual property policy dynamically. From the three dimensionalities of economic foundation,sustaining elements and participation subjects,this paper researched on the basis,impetus and content of intellectual property policy adjustment. The optimal intellectual property protection intensity is diverse during different national developing stage. With the lift of economic development level and the transition of economic development model,intellectual property protection should be strengthened,strict intellectual property policy is a gradual tendency. On one hand intellectual property policy will facilitate innovation,on the other hand innovation capability will change the national intellectual property policy.
