性别视阈下完善妇女生育权的保障研究

Research on the Protection of Women's Reproductive Rights under the Gender Perspective

目前我国立法对妇女生育权给予较多关注,其虽对保护妇女生育权有一定的积极影响,但却缺乏相应的实施机制和救济途径,致立法的预期目的没有得到较好实现。分析了我国妇女生育权保障的现状及其所存在的问题,本文就我国妇女生育权保障制度的完善提出建议:建立两性生育权冲突解决机制;解决贫困地区妇女生育权的保护;建立保障机制以保护女性职工生育权;辅助生殖技术应明确女性生育权保护。

At present women＇s reproductive rights have been given more attention to in the legislation in China, and the rules have a positive impact on the protection of women＇s reproductive rights, but because of the lack of corresponding implementation mechanism and relief way, the intended purpose of the legislation has not been well realized. Based on the analysis on the present situation and existing problems of women＇s reproductive rights protection in China, this paper puts forward the following suggestions to improve the security system of women＇s reproductive rights in China： establishing a resolution mechanism for reproductive rights conflict; pro- tecting women＇s reproductive rights in poverty-stricken areas; establishing safeguard mechanism to protect female worker＇s right to give birth; using assisted reproductive technology to define the protection of female reproductive rights.
