摘要
教育惩戒一直是教育理论和实践中一个比较敏感的话题。教育惩戒在现实中面临着"过度惩戒"中"度"的边界难以厘清、"侵权惩戒"中"权"的规定模棱两可、"不用"与"滥用"的"随意惩戒"时有发生的困境;教育惩戒的合目的性、合规律性、合存在性确证了其合理性及必要性;明晰教育惩戒的正当性,保证教育惩戒的教育性,是教育惩戒走出困境的理性选择。
Education punishment has always been a sensitive topic in educational theory and practice. Education punishment faces the following problems in reality: the "degree"of the border in "excessive punishment"is difficult to clarify; the regulation of "right"in "tort punishment"is ambiguous; "nonuse"and "abuse"of "arbitrary punishment"occur occasionally. So,the purpose,regularity,and beingness of educational punishment confirm the rationality and necessity of its existence. Of course,to clarify the legitimacy of educational punishment and ensure the instructiveness of educational punishment has become a rational choice to help education punishment get out of the predicament.
