A Probe on Legal Risks and Recommendations for Metro Facilities Protection

中国城市地铁建设已走过50多年的历程,在其快速发展的同时,地铁设施遭到外部损害的问题与风险也日渐突出。为探讨和分析地铁设施保护面临的风险,对地铁设施保护的立法和执法提供建议,以地铁管理方面的立法文件及地铁设施保护实践为研究对象,对地铁设施保护面临的风险及相关规范性文件、地铁设施保护实践进行分析总结,认为应当进一步完善法律法规体系、加大执法普法力度、加大责任追究力度,为地铁事业的发展创造更好的外部环境,更好地推动地铁事业健康发展。

Metro construction works have been developing in China for over 50 years. With the massive development of metro works, the problems and risks of metro facilities damages have grown as well. To analyze the risks of metro facilities protection and make recommendations on the legislation and enforcement, the risks confronting metro facilities and the relevant regulatory files have been studied. It is recommended to further improve legislation system, enhance the law enforcement level, which will benefit the creation of better development situations and promote healthier development of metro enterprises.
