摘要
我国作为全世界陆地边境线最长的国家,分布有120余个沿边口岸,与15个国家接壤,沿边地区繁荣稳定发展,是我国经济、政治、生态、社会繁荣稳定发展的保障。尤其是十八届三中全会以来,随着扩大内陆沿边开放的步伐加快,车辆跨境行驶作为加强与周边国家和地区经贸往来、密切周边关系的必然结果,数量越来越大,需求也越来越广泛,对维护边境稳定,推动与周边国家和地区的经贸往来、人文交流意义重大。目前,我国海关对边民自驾车(跨境非货运车辆)的管理仍然存在诸多问题,亟需进行优化和完善。本文从优化顶层设计,完善法律法规视角对解决边民自驾车监管难题提出了意见建议。
As a country with the longest land border,China has over 120 ports along the border neighboring 15 countries. The stability and prosperity at the border is essential to our economic,political,ecological and social development. Especially since the 3 rdPlenary Session of the 18 thCentral Committee of the CPC,the pace of further opening up in the inner land along the border has picked up. As an inevitable result of the efforts to strengthen the trade and intercourse with the neighboring countries,the cross border movement of vehicles has increased in quantity and demand,thus weighing greatly in maintaining the border stability and promoting the trade and cultural exchanges with neighboring countries and region. At present,there still exist many problems for China Customs in the control over the cross-border movement of non-commercial vehicles owned by residents along the border or cross border non-freight vehicles,which should be addressed properly and urgently. The paper proposes some solutions to the difficulties from the perspective of top design and improvement of legislation.
