Cyberspace as a Public Forum:Starting From Public Websites

在网络语境下,为保护言论表达权,公共网站被期待是一种公共论坛的代表;为此,公共网站的财产权、互联网的运作机理及政治功能的三个基准是现有论说潜藏的分析思路。在财产权方面,其论证基点在于公共网站的公有财产基础;于互联网运作机理,则围绕网络的交互性、非稀缺性资源判准进行;在政治功能上,聚焦于平等的价值和"自我实现"、多元价值和"社会善治"层面的阐释。即便如此,随着网络科技的发展,由私主体控制和拥有的商业、个性化网站、信息平台对人们生活的影响日益突出,公共论坛原理在网络空间中的运用遭遇界定判准模糊的难题。尽管有学者尝试引进功能主义解释方法,重新诠释"公共"的内涵,希冀将他们纳入公共论坛范畴,但这已超出公共论坛原理的"理论射程"。

In the Internet context,public websites are expected to represent public forums for the protection of the right to express views.Therefore,the three principles of the property right,the operation mechanism and the political function of the public website are the hidden analysis ideas of the existing discourse.In property rights,the argument is based on the public property base of public websites.As for the mechanism of Internet operation,it is based on the interactive and non scarce resources of the network.In the political function,it focuses on the explanation of the equal value and the realization of self,the pluralistic value and the good governance of society.Even so,with the development of network technology,the commercial,personalized websites and information platforms controlled and owned by private agents have become more and more important to people＇s life.The use of public forum principles in cyberspace has encountered a problem of defining ambiguity.Although some scholars try to introduce functionalist interpretation methods,reinterpret the connotation of ＂public＂ and hope to incorporate them into the scope of public forums,this has gone beyond the ＂theoretical range＂ of the public forum principles.
