司法确认制度实践调研的困扰、反思及建议——以W省司法确认实践为样本

Practice,Reflection and Perplex on Judicial Confirmation System:a Sample of the Judicial Confirmation of Province W

针对我国中部某省各基层法院从2011年至今的司法确认制度实施情况,从模式、流程到案卷,从动态到静态,展开全方位实证调研,使存在于司法确认案件真实度、运作模式、案件质量中的问题得到真实反映。针对司法确认制度在实践推行中的各种偏差和混乱,提出以下完善建议:继续坚定对司法确认制度的价值认知;将司法确认案件与普通案件分别管理;同时加大宣传,提高民众的知悉度;积极探索工作新模式,加强业务工作的规范管理等。

An empirical investigation was made on judicial confirmation system implementation of the grass-roots court in a central province of China from 2011 to the present,from the patterns,processes to files,from staticto dynamic way,which reflects the true problems that exist in the judicial confirmation case,operation mode and case quality.In view of the various deviation and confusion of judicial confirmation system in practice,the suggestions are put forward for improvement：we should continue to hold value recognition of judicial confirmation system;The judicial confirmation case and ordinary case should be managed separately;At the same time we should increase the propaganda,improve people’s knowledge on judicial confirmation system;And we should actively explore new working mode to strengthen the regulation management of business.
