我国自由贸易试验区外商投资制度改革

我国自由贸易试验区在外商投资制度改革方面,确立了以准入前国民待遇和负面清单管理模式的外商投资准入制度、以政府行政审批"一站式"服务为特点的商事登记备案制度、以取消事前审批加强事中事后监督为核心的监管制度。自由贸易试验区外商投资制度与国际经济贸易投资规则深度接轨,对未来我国其他自由贸易区外商投资制度的建立及实施起到了良好的示范作用。但是,目前自由贸易试验区外商投资制度改革仍处于初期阶段,尚存一系列有待进一步解决的问题。为不断完善外商投资制度,本文认为,应审慎完善投资准入制度,加强负面清单的顶层设计;积极改善商事登记备案制度,降低交易费用、提高行政管理效率;继续探索创新事中事后监管制度,提高监管的约束和激励效应。

China Free Trade Zone has established three new systems in terms of foreign investment regime reform： foreign investment access system taking pre-access national treatment and negative lists as administration method, commercial registration system characterized by the ＂one-stop＂ service of government administrative examination and approval, and regulation sys- tem using the cancellation of prior approval and the improvement of supervisions in/after events as the core. The foreign investment system in the free trade zone is in line with the rules of international economic and trade investment, which plays a good exemplary role in the establishment and implementation of the foreign investment system in other free trade zones in the future. However, the reform of the foreign investment system in the free trade zone is still in its initial stage, and there are still a series of problems to be solved. To improve the foreign investment system, this paper puts forward some suggestions to be prudent to consummate the investment access system and strengthen the top-level design of the negative list, to actively improve the commercial registration system, reduce transaction costs and improve administrative efficiency, to continue to explore innovative things in the post regulatory system and improve the regulatory constraints and incentive effect.
