媒体充裕视角下网络文学抄袭治理研究

A Study on Network Literature Plagiarism Governance from the View of Media Adequacy

网络文学抄袭成为制约产业前行的重要原因。近年来不仅抄袭规模有着上升趋势,而且抄袭手段日趋多样,一些带有抄袭"原罪"的作品更是成为明星IP。网络文学抄袭之所以难以治理,一是因为平台管控失效;二是因为司法维权途径艰难;三是媒体监督力量薄弱。网络文学抄袭的治理,应当强调整体的外部管控,从而倒逼平台强化内部监管。具体治理应该在生产层面强化行业协会对文学生产平台的整体管控,在传播层面建立媒体监督激励机制,在政策调控方面建立"黑名单"制度,在司法保障层面简化网络文学抄袭案件审理程序,同时加大执行力度。

Network literature plagiarism has become an important factor restricting the industry development.In recent years,the scale of plagiarism has an upward trend with increasingly complex means of plagiarism,so that some works withoriginal sin ＂plagiarism become star IPs.The reasons are as the following：the difficulty to control the plagiarism of the network literature,the platform control failure,the difficult judicial protection,and weak media supervision.The network literature plagiarism management should emphasize the overall external control,which force the platform to strengthen internal controls.As for the measures,we should strengthen the overall control of the industry association to the literary production,the establishment of media supervision and incentive mechanism to achieve prizes report,establishingblacklist＂ system in the policy regulation,and simplifying the process of network literature plagiarism trial proceedings.
