论少数民族文化权利保障的法治建构

On the Construction of the Rule of Law in the Protection of Minority Cultural Rights

少数民族文化权利保护是人权价值全面实现的重要内容,其在各方面的共同推动下取得了巨大的成就,但在法律体系完善、权利范围确定、义务规定和司法有效救济等方面仍存在不足。从意识养成、制度生成和行为铸成等方面着手,论证完善少数民族文化权利的法治建构,夯实少数民族文化权利保障的本体基础、法治基础和实践基础,对于切实保护少数民族文化权利,实现中华民族文化多样性的统一具有建设意义。

The protection of the cultural rights of ethnic minorities is an important part of the full realization of human rights; It has made great achievements under the impetus of all the forces. However, there are still many deficiencies in the perfection of the legal system, the determination of the right scope, the compulsory norms and the effective relief of the judiciary.The paper analyzes the formation of consciousness, the generation of system and the casting of behavior, and argues that the construction of ethnic minority cultural rights of law, strengthening the cultural rights of ethnic minorities, the rule of law and practical basis for the effective protection of minority cultural rights, realization of the unity of diversity of Chinese culture, has the positive meaning of construction.
