我国抛坠物损害赔偿制度存在四个方面的问题,分别为:抛坠物限定的范围较狭窄,不能满足社会需求;归责原则具有除外责任的性质,但其适用不明确且仅此原则不足以说明该制度的归责过程;责任人仅规定为有致害可能性的人不合理;从责任人承担责任的方式、性质、范围三个方面,得出该制度的责任承担不明确。
