南非不公正解雇立法与实践的启示——以皮厄纳尔诉斯坦陵布什大学及齐科特教授案为例

摘要 南非劳动关系立法对不公正解雇作了详细而具体的规定,为了解南非不公正解雇的立法与实践的运行,特选取皮厄纳尔诉斯坦陵布什大学及齐科特教授案进行分析和论述。案例中,南非法官在处理不公正解雇时,对劳动关系的确认、劳动争议程序的选择以及遵循先例原则等都给予我国劳动司法实践和劳动法学研究以启示。基于此,我国在司法实践中需以劳动关系的确定为立案的前提;重视司法判例在审判中的参照作用;注重公正合法、保障权益和追求效率。 The labor relation legislation in South Africa provides detailed and specific provisions for unfair dismissal.In order to understand and know about the legislation and practical application of South African unfair dismissal and its revelations to our country,we carefully choose the case of Abel Jacobus Pienaar v Stellenbosch University Prof.U Chikte for analysis and discussion.In the case,when the judge dealt with it,the confirmation to the labour relations,the selection of disputes settlement procedure,and the principle of follow the precedent have given revelations to the labour law research and labour judicial practice of our country.Based on this,the determination of labor relations should be the premise of case filing in judicial practice.The importance should be attached to the reference role of judicial precedent in trial.The fairness and legality should be focused on,interest should be protected and efficiency should be pursued.
