On the Value of China's Constitution of the Year 1954

1954年宪法是新中国第一部宪法,同时,这部宪法对之后的我国三部宪法的诞生产生了重大的影响,特别是为现行的1982年宪法的诞生奠定了良好的框架和理论基础,它在我国宪法发展史中占有重要的地位。然而,1954年宪法却由于诸多原因在实施中未能完全体现它的优良价值,也未能尽显它的基本设计功能。本文在探讨1954年宪法价值基础上,详细分析了1954年宪法未能坚持实施的原因,旨在总结历史经验教训,期望对我国当今的法治建设有所裨益。

The constitution ol the year 1954 is the first constitution ol n e w C h i n a,and at the sam e time,it has greatinfluences on the three constitutions afterwards in China. In particular,it laid a good frame and theoretical basis lorthe current constitution of the year 1982,which plays an important role in the history of constitutional developmentin China. However ,the constitution of the year 1954 has not fully reflected its good value in its implementation form a n y reasons,and failed to show its basic design function. Based on the discussion of the value of constitution ofthe year 1954,this paper analyzes in detail the reasons w h y the constitution failed to be implemented. T h e goal is tosummarize the historical experience and lessons,hoping it to be beneficial to the construction of the rule of law inour country.
