Research on the Theoretical Foundation of Marxist Theory of Rule by Law in China

马克思主义法治理论中国化是在马克思主义法治理论基础上,以毛泽东思想、邓小平理论为指导,结合中国的实际国情和现状,将治国理政的经验与实践相结合并使其理论化的法治方针。本文从历史、现实和学术三个方面来分析马克思主义法治理念对中国法制建设的重要作用与意义,分析马克思主义法治理论中国化的内涵和在中国的实现途径,深度剖析马克思主义法治理论中国化对社会主义法制建设的促进与完善作用,为中国特色社会主义法制建设指出了正确的道路。

Marxist theory of rule by law in China is a policy of rule by law which combines the experiences of governing a country with practice and makes it be a theory by basing on Marxist theoretical foundation,guiding with Mao Ze-dong Thought and Deng Xiao-ping Theory and combining with the actual situation in China. From historical,realistic and academic perspectives,this paper analyzes the important role and significance of Marxist concept of rule by law in China's legal construction,discusses the connotation of Marxist theory of rule by law in China and its realization path in China,and explores the roles of Marxist theory of rule by law in China in promoting and improving socialist legal construction,giving correct ways for China's construction of socialist legal system with Chinese characteristics.
