当前新建本科院校在法治化建设方面存在的缺失主要包括:法律不够健全,部分法律需要修订;贪污腐败频发;一些新建本科院校领导法制观念不强;高度的行政化;办学自主权未能得到有效保障。在当前依法治国背景下,新建本科院校的法治化建设路径为:政府科学制定和修改关于新建本科院校的法律法规;新建本科院校应制定适合自身的大学章程;正确处理好行政权力和学术权力的关系;大力推动高校法治文化建设;建立严密的法治监督体系。

The current problems of law construction of New Undergraduate University mainly includes ： the law is not perfect, some laws need revision;corruption cases are common;some leaders of new undergraduate university have little legal awareness;the degree of administrated higher education is higher; university-running autonomy has failed to get effective guarantee. The paths of law construction of new undergraduate university under the background with the rule of law are： the government should scientifically formulate and modify the laws and regulations of new undergraduate university; new undergraduate university should formulate university chart which is suitable for its own;it should correctly handle the relationship between the administrative power and academic power;it should vigorously promote the construction of the law culture of university;it should establish a strict rule of the supervision system.
