摘要
农村承包土地的经营权和农民住房财产权(即"两权")抵押贷款是盘活农村土地资源、更大程度的赋予农民财产权、推进农村金融改革的一项重要举措。但目前"两权"抵押贷款实施遇到很多困难,尤其是存在一定的法律限制和法律空缺,应对相关法律进行修改完善,解决当前问题。《物权法》和《担保法》中的一些法条与"两权"抵押贷款能否合法进行息息相关,因此,必须对相关法条进行相关修改完善。在《物权法》和《担保法》中,必须剔除一切有碍"两权"抵押质押贷款的因素,增加保障"两权"抵押质押贷款规范化进行的条款。
The right of management for the rural contracted land and the farmers' housing property rights( namely, " two rights") mortgage loan is an important measure to enliven the rural land resources,give the farmers more property rights and promote the rural financial reform. However,there are many difficulties in the implementation of the " two rights" mortgage loan,especially the legal restrictions and legal vacancy. Therefore,it's necessary to revise and perfect the relevant laws so as to solve the current problems.
