二轮摩托车交通事故中驾乘关系的分析研究

在二轮摩托车交通事故中，经常会有多人死伤的情况，因此准确判定驾乘关系对于事故鉴定和责任认定至关重要。但大多数案件往往缺乏典型驾乘关系特征，导致事故鉴定和处理工作难以开展。本文通过一起二轮摩托车交通事故案例，全面运用事故现场痕迹、二轮摩托车的车体痕迹、驾乘人员的人体痕迹及人体损伤特征等相关元素，综合分析判定二轮摩托车事故发生时车上人员的驾乘关系。

Road accidents involving two-wheeled motorcycles usually result two or more casualties, therefore, accurately identifying the rider and the passenger is very important in the process of traffic accident identification and responsibility determination. However, for the cases lack of typical body injury characteristics to distinguish the rider from the casualties, it is necessary to make a comprehensive analysis based on the traces of the traffic accident scene, the motorcycle andbody injury. This paper intends to analyze a case and try to distinguish the rider from the casualties of the two-wheeled motorcycle accident by taking the traces of the motorcycle, the scene of the accident and thebody injury characteristics of the casualties into consideration.
