论行政强制措施检察监督特别程序的设计

The Procedure of the Administrative Compulsory Measures under the Procuratorial Supervision

不同于一般行政行为,行政强制措施临时性、紧急性和严重性等特殊性构成了建构行政强制措施检察监督特别程序的必要性。但这种程序设计可能存在监督主体与被监督主体产生激烈对抗,与行政复议、行政诉讼发生冲突,监督方式缺乏刚性导致最终无法落地等法律风险。在当前的政治体系和司法架构下,这项程序的顶层设计方案必须从国家治理的角度出发,充分重视借鉴试点经验和教训,分析法律风险,理性设计这套程序的静态构成要素和动态运行方案,并在此基础上加强检察权运行的监督和制约。

Administrative compulsory measures are temporary, urgent and serious which is different from general administrative behavior. It is necessary that the special procedure be designed of the administrative compulsory measures under the procuratorial supervision. However, this kind of procedure run the risk of increasing the heated confrontation between the main body and the object, interfering with administrative litigation and administrative reconsideration, failing to perform ultimately because of the weak methods. The procedure must be designed under the perspective of national governance in the current political system and legal framework. We need to take the following measures, paying attention to the pilot experience and lessons, analyzing the legal risks, designing the procedure of static factors and dynamic operation scheme rationally, strengthening the supervision and restraint of the procuratorial authority.
