交互式网络电视版权侵权问题研究

随着传播技术不断发展更新,版权保护问题受到挑战,交互式网络电视是集计算机互联网、广播电视传输网、电信传输网于一体的新的传播技术,给用户带来便利的同时,也引起了著作权侵权纠纷。通过交互式网络电视技术对电视节目和影视作品进行回看、点播,不属于广播行为,而是信息网络传播行为,且也不存在合理使用的法定免责情形。因此,未经著作权人许可,该行为侵犯了著作权人的信息网络传播权。

The problem of copyright protection is always challenged with the development of communication technology. IPTV is a new communications integrating the internet, television network and telecom network. IPTV is convenient to its users but also causes the copyright infringement. The IPTV customers will be provided with services like watch-back and on-demand. It does not belong to the broadcast behavior, but belongs to the information network dissemination without the statutory exemptions. So this behavior infringes the right of information network dissemination.
