法治与改革关系的协调——以授权规则运用下的地方试验为进路

Taking balance between the rule of law and the reform:Practice of rules of authorization in local experiments

法治与改革的冲突并非当前二者关系的主要方面。短期讲,二者均在全面建成小康社会中扮演着至关重要的角色;长期看,法治是改革的目标,改革是法治的动力。在此前提下,当前法治与改革间的张力直接反映在如何协调法律本身的稳定性与变动上。在全面深化改革进程中,可以选择运用授权规则规范与引导改革的地方试验,将其纳入法治轨道,从而协调法治与改革的关系。

The principal aspect of relationship between the rule of law and the reform is not conflict. Both the rule of law and the reform are playing vital roles in completing the building of comprehensive well-off society; and in a long-term view, the rule of law should be the goal of reform and the reform will excite dynamics of the rule of law.It＇s an actual matter that how to reconcile the conflicting demands of laws＇stability and change. In a new period of comprehensively deepening the reform, what could be useful for taking balance between the rule of law and the reform is the scientific practice of rules of authorization in local experiments.
