Research on Time Extension of Administrative Coercive Measures

行政主体为了保证行政效能的实现,经常实施行政强制措施。而行政强制措施实施的结果直接影响行政相对人的人身自由、财产权利等。因此,法律法规为了保证行政相对人的合法权利以及行政效率与公平,对行政主体实施行政强制措施的期限和延期进行相应规定。从法律规定和社会现实角度探讨行政强制措施延期的原因,正负效应以及缺陷和完善措施等,是保证行政强制措施的公正效率,维护社会和人民群众利益的重要举措。

Administrative coercive measures are the behaviors that administrative subjects adopt to make sure administrative effi- ciency can be guaranteed. Its result can affect the private party＇ s freedom and property rights and so on. As a result, the time limit and extension of administrative coercive measures should be regulated in order to protect the rights of private party, balance efficiency and equity. So, this thesis tries to explore the reasons, positive and negative effects of the time extension of administrative coercive measures from two angles： the laws and regulations, the social reality, and then find the drawbacks and solutions to it. This is an im- portant measure to make sure the administrative efficiency and equity, to protect the people＇ s rights.
