摘要
在土地市场持续火热、地王频出的背景下,我国部分热点城市借鉴金融监管的做法,在土地出让中推出"熔断机制"。"熔断机制"旨在降低开发企业的拿地成本,稳定房地产市场,其实施具有正当性。然而,由于缺乏充分的上位法依据,可能扰乱土地出让的节奏,也没有从根本上改变土地供求关系,其实施效果难言乐观。在建立房地产市场健康发展的长效机制中,应该根据市场形势相机确定出让底价,优化土地供应方式,审慎适用"熔断机制"。
In the background of overheated land market and "land king"appeared constantly, some hot urban cities in China imitated the practice of financial regulation, introducing Circuit Breaker in land transfer. "Circuit Breaker"aims to reduce the land cost,stabilizing the real estate market. However,lt lacks of adequate basis of the superior law,may disrupt the rhythm of land transfer,nor does it fundamentally change the land supply and demand relationship, whose implementation effect is not optimistic. Under the real estate market healthy development of long-term mechanism, we should base on the market situation to determine the reasonable reserve price by the discretionary approach, optimize the land supply, carefully apply the"Circuit Breaker."
