国家调节对经济法管理经济本质的揭示——兼论经济法的核心范畴

文章认为,国家调节充分体现了经济法的本质特征,是经济法的核心范畴。因为国家调节科学地界定了政府与市场职能,主张国家以引导和促进方式来管理国民经济。国家调节是经济法核心范畴构成的内在要求,它不仅有利于把经济法和民商法、行政法等部门法区分开来,也有利于经济法理论的不断完善,是建构经济法理论和经济法范畴体系的基础。

This article considers that the characteristic of national regulation fully embodies the essence of economic law, which is he core of the economic law category. State regulation scientifically define the functions of government and market, argues that the State hould guide and promote to manage the national economy. State regulation is the inner requirement of the core of economic law, it is not rely beneficial to distinguish among economic law and civil law, but also conducive to the continuous improvement of the theory of ：conomic law. It is the foundation of the construction theory of economic law and economic law category system.
