摘要
目前,京津冀区域大气污染治理的利益平衡机制尚不完备,集中表现在大气生态补偿制度缺乏法律依据和补偿标准、资金来源的政策不统一、政府对企业和个人利益补偿的相关规定不够完善等方面。从域外来看,以德国为代表的欧盟区域大气污染治理有着比较完善的生态补偿制度,并注重发挥市场机制和环境税收体系在大气污染治理中的作用。京津冀也应从进一步明确大气生态补偿的法律依据、完善具体生态补偿制度、健全对企业及个人的生态补偿相关规定着手,构建起科学合理且有效的大气治理利益平衡机制。
Currently,the interests balancing mechanism of control of air pollution in Tianjin and Hebei province is still not mature enough,with major problems such as the lack of legislative authority in the ecological compensation mecha- nism,the disparity between the policies concerning compensation criterion and sources of funds,the inadequacy of regu- lations on government's compensation for businesses and individuals.Turning to fi^reign countries,we can see that both Germany and EU have relatively perfect ecologic:al compensation mechanisms in the aspect of air pollution controlling, and pay attention to the role of market mechanism and environmental tax system in air pollution controlling.Start from further specifying the legal ground of air ecological compensation,improving specific ecologic:al compensation system and perfecting regulations concerning compensations for businesses and individuals,the Beijing-Tianjin-Hebel regions should construct a scientific,reasonable as well as effective interests balancing mechanism of air pollution controlling.
