人的身份具有外在性,但它是客观的,并决定人格。身份具有等级差异的社会现实与人格人人平等的制度规范间存在冲突。人格平等应当只限于人与生俱来的人之所以为人的自然属性的平等,由人的不平等身份所决定的人格的社会属性是不平等的。人的犯罪身份具有降低其社会人格效应的现象和法人制度出现的事实均是双重人格属性理论的有力证明。
