浅析越南《商事仲裁法》仲裁庭组成制度

A Discussion on Constitution System of Arbitration Court in Vietnam's Commercial Arbitration Law

越南《仲裁法》的仲裁庭组成制度与中国《仲裁法》的仲裁庭组成制度不同,越南《仲裁法》对临时仲裁庭的支持和仲裁员人数的灵活性对中国《仲裁法》的完善有借鉴意义。中越两国仲裁法均存在仲裁员资格规定僵化、仲裁员回避决定不受司法复审等问题。我国《仲裁法》应从放宽仲裁形式的限制、放宽仲裁员人数的限制、放宽仲裁员资格的限制、赋予当事人对仲裁员回避决定请求司法复审的权利等方面进行完善。

Constitution system of arbitration court in Vietnam＇s Arbitration Law is different from that of China. Vietnam＇s Arbitration Law＇s support for temporary arbitration court and the flexibility of the number of arbitrators are of great reference for improvement of China＇s Arbitration Law. Both Vietnam＇s and China1 s Arbitration Law witness rigid regulations for qualification of arbitrators, absence of judicial review for arbitrators1 avoidance of decisions. China＇s Arbitration Law is expected to be improved by relaxing the restrictions on the arbitration forms, the number of arbitrators, and qualification of arbitrators and granting the parties with the arbitrators＇ rights to request judicial review through avoidance of decisions.
