New Interpretation of Distruction of Civil Aviation Facilities:A Perspective of the Risk Society

风险社会视角下,破坏民用航空设施犯罪在行为方式、行为对象及犯罪性质等方面体现出新特点,需要对民用航空安全法益进行前置化保护。针对破坏民用航空设施犯罪的立法缺陷,需增设抽象危险犯—破坏民用航空设施罪,并配置合理的法定刑,回应风险社会对民用航空领域犯罪的冲击,从而实现与国际公约的有效衔接。

IViewed from the perspective of the risk society,the crimes of distruction of civil aviation facilities incarnate new characteristics in terms of behavior styles,behavior objects and the crime natures.Accordingly,pre-protection of civil aviation legal security interests is urgently necessary.Based on the legislative defects of the crimes of distruction of civil aviation facilities,abstract potential damage offences,namely,crimes of distruction of civil aviation facilities need to be added and configurated with reasonable statutory sentences so as to respond to the impact of the risk society on the crimes of distruction of civil aviation facilities and realize effective connection with international convention.
