船舶大气污染之法律规制

On Regulating Air Pollution from Ships

随着经济的发展,船舶大气污染问题日益受到重视,联合国《防止船舶污染国际公约》(MARPOL73/78)已对船舶大气污染做出了规定。然而,由于船舶大气污染的跨区域性加之具有极强的流动性,对船舶大气污染的防治仍然有待于公约各缔约国的积极努力。空气污染治理的迫切性要求我国对船舶大气污染予以高度重视。然而,与发达国家相比,我国无论在防范意识还是在法律制度建设层面上均存在巨大差距。为了从根本上防治环境污染,我国应积极履行国际公约采取措施防止船舶大气污染,如继续加大在各港口及各排放区对船舶大气污染物进行有效排放控制。

Along with the economic development,ships are now among the largest sources of air pollution.Most countries signed an international agreement known as MARPOL73/78 to prevent air pollution from ships.China now realizes the harm of pollutants emitted from burning this dirty fuel by ships,but lacks emissions control regulations.Compared with the developed countries,there is a huge disparity in the idea of prevention and legal systems.Therefore,the clear obligation settled by MARPOL73/78 is upon China to regulate ships emissions to protect the environment and public health and safety.
