法律真实理论与客观真实理论关系之厘清

Clarification on Relationship between Legal Truth Theory and Objective Truth Theory

从法律真实理论与客观真实理论的基础出发,研究分析了二者的异同、关系,客观真实理论到法律真实理论的演变以及如何平衡二者之间的关系。提出客观真实是法律真实趋近于公平正义的基础,法律真实是客观真实在实务操作中的现实选择路径,只有法律真实与客观真实达到一种平衡与稳定,案件才能取得公平与效率兼得的裁判结果。

Based on the theories of “Legal Truth” and “Objective Truth”,this paper studies the differences, similarities, and relations between the two theories, the evolution of the theory of “Objective Truth” to the theory of “Legal Truth”, and how to balance the two. The paper holds that objective truth is the foundation for legal truth to approach justice; legal truth is the realistic chosen path of objective truth in practice. Only when both of them keep a balance and stability, can both fairness and efficiency of the judgment of a case be achieved.
